Background – The Alaska Department of Environmental Conservation (ADEC), Water Division issued a certificate of reasonable assurance on the Army Corps of Engineers’ Clean Water Act Section 404 permit for the Donlin Mine in 2019. That decision was appealed and Commissioner Brune upheld the Water Division’s decision. The issue was then appealed to Superior Court and the decision was remanded back to the department to consider additional information. Based on the additional information, the Water Division reaffirmed their decision. Orutsararmiut Native Council requested an adjudicatory hearing on June 13, 2022. Based on the responses to the notice of request for adjudicatory hearing and recommended decision from the Office of Administrative Hearings, the Commissioner has granted a hearing.

A person requesting to intervene must serve a copy of the request to intervene on each party (the division director, the requestor, and the applicant). An existing party may submit an objection to a request to intervene within seven days after service of the request.
