NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

This notice shall satisfy a procedural requirement for Title VI to be undertaken by:

REQUEST FOR RELEASE OF FUNDS

On or about July 2017, the said organizations will authorize the Association of Village Council Presidents Regional Housing Authority (AVCP RHA) to submit a request to the Alaska Office of Native American Programs (ONAP/HUD) for the release of Title VI funds, as amended, to undertake projects known as Atmautluak Title VI New Development. The projects consist of: construction of (2) Units in Atmautluak located at Lots 3 and 4 Block 2, Atmautluak Church Lane Road Subdivision Addition No. 1, at an estimate cost of $400,000 per single family unit.

PUBLIC COMMENTS

Any Individual, group or agency may submit written comments on the ERR to the AVCP RHA Planning Department. All comments received by the end of July 2017 will be considered by the said Tribes prior to authorizing submission of a request of funds.

RELEASE OF FUNDS

The said organization certify to AONAP/HUD that Henry Active for Atmautluak Traditional Council, in his capacity as President consent to accept the jurisdiction for the Federal Courts is an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. AONAP/HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows to the said organization to use Program Funds.

OBJECTIONS TO RELASE OF FUNDS

AONAP/HUD will consider objections to its release of funds and the said organization’s certification for a period of fifteen days following the anticipation submission date of it’s actual receipt by HUD REGULATIONS AT 24 CFR Part 58; the grant recipient had committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by AONAP/HUD; or another Federal Agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CRF Part 58) and shall be addressed to AONAP/HUD at 300 C Street, Suite 401, Anchorage, Alaska 99503. Potential objectors should contact AONAP/HUD to verify the actual last day of the objection period.
