A Bureau of Land Management (BLM) Draft Summary Report and the State of Alaska’s application for a Recordable Disclaimer of Interest for the Lands Underlying the Kanektok River System (including Pegati and Kagati lakes) is available for review and comments. You may comment on the BLM Draft Summary Report and the State’s application through May 9, 2018. All interested parties may submit comments through the Bureau of Land Management, Chief, Branch of Cadastral Survey, 222 W. 7th Avenue, #13, Anchorage, Alaska 99513-7599. Notice is hereby given, the State of Alaska, Department of Natural Resources submitted an application on Mar. 1, 2012, for a recordable disclaimer of interest pursuant to 43 CFR Subpart 1864. The recordable disclaimer of interest, if issued, will confirm the United States has no valid interest in the lands covered by the application. The State asserts that this river system is navigable; therefore, under the Equal Footing Doctrine; the Submerged Lands Act of 1953; the Alaska Statehood Act of 1958; the Submerged Lands Act of 1988, and other title navigability law, ownership of these lands underlying the river automatically passed from the United States to the State at the time of statehood in 1959. The State identified the Calista Corporation, Qanirtuuq, Inc., and the FWS, as possible interested parties of the affected lands.
The BLM case file AA-93210 (Kanektok River System, including Pegati and Kagati lakes), the application is for submerged lands within the bed of the Kanektok River up to and including the ordinary high water line of Pegati and Kagati lakes within township 3 and 4 south, range 63 west, Seward Meridian, Alaska and for the submerged lands and bed of the Kanektok River lying between the ordinary high water marks of the right and left banks of that river from the outlet of Pegati Lake within township 3 south, range 63 west, Seward Meridian, Alaska, downstream to the location where the river enters the Kuskokwim Bay in township 5 south, range 74 west, Seward Meridian, Alaska.
